Rights of Night Shift Workers Under India's Labour Codes

Your rightsGrievance route: IR Section 4

In short: If you work nights, you are owed your wages on time, a working day capped at eight hours, and gratuity after five years. If you are a woman on a night shift, you cannot be made to work without your consent and safe conditions.

Your night shift entitlements across seven heads

This table maps what the supplied codes give a night shift worker across seven heads: wages, hours, leave, social security, safety, the night-specific protection, and the complaint route. Where the code leaves a figure to rules, or does not cover a head, the cell says so plainly instead of guessing.

Entitlement headWhat you get as a night shift workerSection

Rule-set cells: breaks and spread-over hours, the safety conditions for women on night shifts, and the grievance form are set by government notification or rules, not by fixed numbers in the codes. The amount of gratuity is not in the supplied text, only the entitlement and the five-year threshold. Leave, PF and ESI are not covered by the statutory text used for this page. No assumed or illustrative numbers are used in this table.

What your employer must give you

Working a night shift does not lower what you are owed. The same four labour codes that protect a day worker protect you. Here, in plain terms, is what your employer must give you.

What to do if you are denied

If any of the above is denied, night wages short-paid, hours pushed past eight without the breaks you are due, gratuity refused, or a night shift put on you without consent, act in order and keep your proof.

Where to complain: authority, form and time limit

Your formal route for an individual complaint is the Grievance Redressal Committee. Here is who runs it, who can file, by when, and how long it has to decide.

Where to check your state

Labour in India is run jointly by the Central Government and the states, and many of the numbers that matter most to a night worker are set by whichever government notifies the rule.

Night pay and night hours: what these codes actually say

It is worth being clear about what these codes do and do not fix for night work, so no one misleads you about a number.

Frequently asked questions

Does the law give me extra pay for working nights?

Based on the statutory text used for this page, no separate night pay rate is set. These codes cap your day at eight hours and require your wages to be paid on time and in full, but any night premium would come from your contract, a settlement, or a rule your government notifies, not from a fixed figure in these provisions.

I am a woman asked to work a night shift. Can they force me?

No. Under OSH Section 43 you may be employed before 6 a.m. or after 7 p.m. only with your consent, and the employer must follow the safety, holiday and working-hour conditions the government prescribes. Consent and safe conditions are not optional for the employer.

How long do I have to complain if my night wages are short-paid?

In an establishment employing twenty or more workers, file with the Grievance Redressal Committee within one year from the date the problem arose. The Committee may complete its proceedings within thirty days of receiving your application and decides by majority. [IR Section 4]

When must I be paid my night shift wages?

If you are paid by the day, at the end of your shift. If you are paid monthly, before the seventh day of the next month. If you leave or are removed, retrenched or dismissed, within two working days. Deductions are allowed only where the Code permits them. [COW Section 17], [COW Section 18]
