The double-rate rule

The Minimum Wages Act and the Factories Act require overtime at twice the ordinary rate of wages. The ordinary rate is derived from the monthly wage over 26 days and 8 hours, so a higher wage raises the overtime rate too. These pages fix the wage and vary the hours, so you can read off the overtime pay for a given month at a glance.

For an employer the rule has one clear implication: there is no compliant way to pay overtime at less than double, so the real control is on the hours themselves. Capturing every overtime hour from attendance, pricing it at double the current ordinary rate, and showing it separately on the payslip keeps both the worker paid correctly and the wage register audit-ready. For a workforce spread across sites, ZeniaHR ties overtime directly to attendance so it is never a flat guess.

One point that catches employers out is that the ordinary rate is not frozen. Where workers are on the minimum wage, it revises every six months with the state's dearness-allowance revision, and the overtime rate rises with it automatically. Paying last cycle's overtime rate after a wage revision is underpayment, exactly the kind of gap a principal-employer audit looks for. These pages fix the wage and vary the hours; for the rule in full, see the overtime wages definition and the minimum wages by state pages.
