What is Break Time at Work? Meaning, Rules and Example

Break time is the period during a working day when an employee stops work to rest or eat, such as a lunch break or a tea break. Some breaks are paid and counted as working time; others are unpaid and excluded from hours worked, as the company's policy and the applicable rules decide.

How breaks are set in Indian workplaces

Offices usually have a lunch break of 30 minutes to an hour and one or two short tea breaks. Factories and hospitals fix breaks by shift so that lines and wards stay covered, often staggering them within a team. Rest intervals are also a legal matter: the OSH Code leaves intervals for rest, spread-over and weekly limits to government notification, so check the notified working hours rules that apply to your establishment before designing shifts.

Paid and unpaid breaks

A paid break counts as working time: the employee is paid for it and it counts toward full-day hours. An unpaid break is excluded, which is why a 9 am to 6 pm shift with an unpaid one-hour lunch is an eight-hour working day. Many companies pay short tea breaks and leave lunch unpaid. Write the rule down, because it changes how full days, half days and overtime are counted.

Example: At Harbour Logistics in Visakhapatnam, warehouse staff on the 6 am to 2 pm shift get a paid 30-minute meal break and a paid 10-minute tea break. The 15 minutes beyond his paid allowance of 40 minutes were deducted from his counted hours, and his supervisor spoke to him about the long second break.

Is lunch break included in working hours?

It depends on the company's policy. In many Indian offices, the lunch break is unpaid and not counted, which is why a 9 am to 6 pm shift with a one-hour lunch counts as eight working hours. Some companies, especially those with short lunch breaks, count it as paid time. The appointment terms or attendance policy should say which applies.

How long should a lunch break be?
