What is Paternity Leave? Meaning and Example

Paternity leave is leave given to a father around the birth or adoption of his child, so he can support the mother and care for the newborn. In most private companies in India it comes from the company's own leave policy, which sets how many days are given, whether they are paid and when they must be used.

How paternity leave works in companies

A typical policy gives a set number of paid days, for example 5, 10 or 15 working days, to be used within a window such as three or six months after the birth. The employee applies with the expected or actual date of birth, and some companies ask for a birth certificate or a hospital discharge summary. Many policies let the days be split into two spells, for example a few days at delivery and the rest when the mother's family support leaves.

Why a written paternity policy helps

Without a written policy, fathers fall back on casual, earned or unpaid leave, and managers decide case by case, which feels unfair. A clear policy tells employees what to expect and signals that caregiving is not only a mother's job. It also supports women returning from maternity leave, because the care load at home is shared from the start.

Setting up paternity leave

How many days of paternity leave are given in India?

In private companies, the number is set by the company's leave policy, so it varies. Many policies offer somewhere between 5 and 15 working days, usually paid and to be used within a few months of the birth, and some employers offer more. Check your leave policy or HR portal for the exact entitlement where you work.

Can paternity leave be taken before the baby is born?

Some policies allow a few days before the expected delivery date, for example to accompany the mother to hospital, while others start the leave only from the date of birth. If your policy counts the window from the birth date, days taken earlier may be treated as casual or earned leave instead. Ask HR before you apply.
