How adoption leave works
The employee informs HR once the adoption is approved and the handover date is known, which can change at short notice. Leave starts from the handover date and runs for the period the policy allows. Companies commonly ask for the adoption order or a letter from the adoption agency. Because the timing of an adoption is less predictable than a birth, the policy should allow the leave to be applied for at short notice without any penalty.

Before writing the policy, HR should check how the maternity benefit provisions of the Code on Social Security and its rules apply to adoptive and commissioning mothers, including any age limit for the child and the conditions attached. The maternity benefit rules are the place to start. Most companies handle leave for adoptive fathers through their own policy, often matching their paternity leave.

Is adoption leave available for fathers?
