Where temporary employees are used
Retailers take on temporary staff for the festive season, factories for peak orders, schools for exam duty, and offices for a data entry backlog or maternity cover. Standing orders commonly classify workers into categories such as permanent, probationer, temporary, casual, badli and apprentice, each with its own rules. The appointment letter should state that the role is temporary, the reason, and the expected duration.
Temporary, fixed-term and contract compared
A temporary employee is on the company's rolls for temporary work, often without a precise end date. A fixed-term employee has a written contract with a set end date and full employee status under the Industrial Relations Code. A contract worker is on a contractor's rolls. When temporary work turns out to be ongoing, or a temporary employee is kept year after year, the label stops matching reality and the arrangement may be treated as regular employment. Review long-running temporary roles and either convert them or put them on proper fixed-term contracts.
Managing temporary staff
Temporary staff still need the basics done properly, even for a six-week engagement. Under the OSH Code, an appointment letter must be issued to every employee, temporary or not, and statutory coverage should be checked rather than assumed away.
- Issue an appointment letter stating the temporary nature and reason
- Check PF and ESI applicability for each temporary employee
- Track the expected end date
- Give the same safety induction as permanent staff
- Record the reason if the work is extended

Do temporary employees get PF and ESI?
Coverage under PF and ESI is decided by the applicability rules for the establishment and the employee's wages, so check them for temporary staff too rather than assuming they are outside. Many temporary employees are covered in the same way as permanent staff. When in doubt, ask your payroll or compliance adviser before the first salary is processed.
Can a temporary employee become permanent?
Yes. Many companies convert temporary staff who perform well when a permanent vacancy arises. The employee gets a new appointment or confirmation letter, and the company decides whether the temporary period counts toward probation or service. If temporary work has quietly become permanent work, converting the role is usually the cleaner option.
