What to include
Issue it before probation ends
An extension letter dated after the original end date is weak, and under some appointment letters the employee may already be treated as confirmed. Track end dates at least a month ahead.
Specific, observable gaps
Write what was seen, such as late reports or missed escalation targets, not labels like poor attitude. Specific gaps are fair to the employee and hold up if the extension ends in non-confirmation.
Measurable targets and support
Every gap needs a matching target with a measure, a review rhythm and the support the company will give. An extension without a plan is only a delay.
Allowed by the appointment letter
Refer to the clause that permits extension and respect its limit. If the appointment letter does not allow extension, discuss it with the employee and record their agreement.
Clear next step
Name the final review date and the two possible outcomes. The employee should not be surprised by either result when the extended period ends.
Common mistakes to avoid
- Extending probation because the manager missed the review, not because of real gaps.
- Writing general criticism with no measurable target to meet.
- Extending again and again beyond the limit in the appointment letter.
- Holding no review meetings during the extended period and deciding at the end.
- Backdating the letter after the original probation end date.

Can an employer extend probation in India?

The extension should be in writing, issued before the original probation ends, and based on specific reasons. If the appointment letter is silent, discuss it with the employee and record their agreement in the letter.
How long can probation be extended?
As long as the appointment letter or standing orders permit, commonly up to the length of the original probation. Longer extensions look like a way to avoid confirming the person. If the gaps cannot be closed in one extension, the company should make a decision rather than extend again.
What should an employee do after receiving a probation extension letter?
Read the gaps and targets carefully and ask the manager to clarify anything vague. Agree a review rhythm, keep a record of progress against each target, and raise support needs early. Sign the acknowledgement, which confirms receipt, and add a written note if you disagree with any finding.
Does the notice period change during extended probation?
Usually not. The notice period that applied during probation continues through the extension, and the longer notice for confirmed employees starts only on confirmation. State this in the extension letter so both sides know the position if either decides to end employment.
