Probation non-confirmation letter format

A probation non-confirmation letter informs an employee that the company has decided not to confirm them and that their employment will end. It is one of the most sensitive letters HR issues, so it must rest on the documented probation reviews, follow the notice terms of the appointment letter and explain how dues will be settled. It should inform, not accuse: the letter records a decision about suitability, not a finding of misconduct.

When to use it: Issue it at or before the end of probation or extended probation, only after documented reviews, feedback meetings and, where given, an extension with targets. The HR head reviews the file, an authorised signatory signs, and the letter is handed over in a private meeting with HR and the manager present. The employee signs a copy as received.

After considering these reviews, the company has decided not to confirm your services, as your performance in [the areas recorded in the reviews, for example: meeting monthly collection targets and report accuracy] has not reached the standard required for the role. Your employment with the company will therefore end on [Last Working Day].

In accordance with your appointment letter, [you are given [Number] days' notice, and you will continue on duty until [Last Working Day] / you are paid [Number] days' wages in lieu of notice, and you are relieved from duty at the close of working hours today].

Your wages up to the last working day will be paid within two working days of that day, and your full and final settlement, covering leave encashment as per policy and any other dues, will be worked out under the law and company policy. Kindly hand back your ID card, laptop and other company property to [Name or Department] and complete the exit formalities with HR. Your relieving letter will be issued once these are complete.

What to include

Rely on the review record

Refer to review dates, meetings and the extension letter, if any. The decision should visibly follow from records the employee has already seen, not from a first mention in this letter.

Suitability, not misconduct

Non-confirmation is a decision about performance or fit. If misconduct is suspected, that needs a separate show cause and inquiry process, and must not be slipped into this letter as an accusation.

Notice or pay in lieu

Apply the probation notice from the appointment letter: either the employee works the notice or is paid wages in lieu and relieved. Write which option applies and the last working day.

Settlement of dues

State that wages will be paid within two working days of leaving, as the Code on Wages requires, and that other dues follow in the full and final settlement.

A dignified handover

Can an employer refuse to confirm an employee after probation?

Yes. Probation exists so the employer can assess suitability before confirming. The decision should rest on documented reviews and feedback the employee has seen, follow the notice terms of the appointment letter, and not be used to hide a misconduct allegation that should have gone through a proper inquiry.

Does an employee get notice if not confirmed after probation?

Yes, the notice period for probationers stated in the appointment letter applies, or wages in lieu of it. Many companies set a shorter notice for probationers than for confirmed employees. Write in the letter whether the employee works the notice or is paid in lieu and relieved.

Should the reason be given in a non-confirmation letter?

Give a brief, factual reason linked to the review record, such as targets not met in the areas already discussed. Avoid personal remarks or new allegations. A short, accurate reason is fairer to the employee and easier to defend than either silence or a long list of complaints.

Will a non-confirmed employee get a relieving letter?

Yes. Once the employee returns company property and completes exit formalities, HR issues a relieving letter and settles dues. The relieving letter records the dates of service and need not mention non-confirmation. Wages must be paid within two working days of the last working day.
