Adoption leave policy template

An adoption leave policy gives paid time off to employees who adopt a child or become parents through surrogacy, so they can settle the child at home and build the bond the first months need. It covers primary and secondary carers, the documents required, time off for agency and court formalities, and how the leave sits alongside any maternity benefit the law gives adoptive mothers.

When to use it: Adopt it as part of your family leave framework, or as soon as an employee says they are going through an adoption. HR drafts it alongside the maternity and paternity policies and management approves it. Check the current maternity benefit provisions for adoptive and commissioning mothers before finalising it.

1. Purpose

This policy supports employees of [Company Name] who become parents through adoption or surrogacy, by giving them paid leave to care for and bond with the child.

2. Scope

It applies to employees with [3] months of service who legally adopt a child below the age of [Number] years, and to commissioning parents in a surrogacy arrangement. It applies to women and men equally, including single parents.

5. Formalities and documents

  • HR: confirm the entitlement in writing and handle adoption information with discretion.

10. Review

HR reviews this policy every [2] years, and immediately if the maternity benefit provisions for adoptive or commissioning mothers change.

What to include

Primary and secondary carers

Define leave by caring role rather than by gender. The policy then works for single parents, for families where the father is the main carer and for surrogacy arrangements.

The link to maternity benefit

The law gives maternity benefit to adoptive and commissioning mothers in certain cases. Write the policy as not less than that benefit, and check the maternity benefit rules for the current conditions.

Time off for formalities

Adoption involves home studies, agency meetings and hearings, often at short notice. A few paid days for these steps saves the employee from spending earned leave on paperwork.

A flexible start date

Start the leave from the date the child is placed with the family, which can change at short notice. Build that flexibility into approvals instead of demanding fixed dates weeks ahead.

Confidentiality

Adoption details are personal. Limit who sees the documents, and make sure the child's background is never discussed in the team.

Common mistakes to avoid

Run it in ZeniaHR

In ZeniaHR Leave Applications, the rules for the adoption leave type can set minimum service, employment types, a cap on days in one application and a document requirement, and approval runs from the reporting manager to HR. Employees see the days to be charged in a live preview before they submit. Adoption and placement papers are stored in the employee's documents, and Access Control decides which roles can open them.

Frequently asked questions

Is adoption leave available in India?

Yes, in two ways. The law gives maternity benefit to adoptive and commissioning mothers in certain cases, and employers can offer adoption leave to both parents through company policy. Check the current conditions in the maternity benefit rules, then write your policy so it gives at least that and adds a benefit for the other parent.

Who is the primary carer in adoption leave?

The primary carer is the parent who takes main responsibility for the child in the first months, whatever their gender, and the other parent is the secondary carer. Defining leave this way lets the policy work for single parents and for families where the father takes the main caring role.

Does adoption leave depend on the age of the child?

Company policies often set an age limit, because younger children usually need a longer settling-in period at home. Any maternity benefit the law gives adoptive mothers carries its own conditions, so check those separately. Some employers also cover older children, with a shorter leave.

Can an employee get leave for adoption formalities?

Yes, if the policy provides it. Adoption involves home studies, agency meetings, medical checks and hearings, often at short notice. A few days of paid leave for these steps, separate from the main adoption leave, keeps the employee from using earned leave for paperwork.
