1. Purpose
This policy gives new employees of [Company Name] a fair period to settle in and show their suitability, and gives the Company a structured way to assess them before confirming their employment.
2. Scope
It applies to employees joining permanent positions. Trainees and fixed-term employees follow the probation terms in their own appointment letters, which should be consistent with this policy.
3. Definitions
- Probation period: the period from the joining date stated in the appointment letter during which the employee's suitability is assessed.
- Confirmation: the written decision that the employee has completed probation successfully.
- Extension: a one-time lengthening of probation, with reasons and an improvement plan.
4. Policy
- Probation is [6] months for [Staff Category] and [Number] months for [Other Category], as stated in the appointment letter.
- Probation may be extended once, by up to [Number] months, only with written reasons and an improvement plan shared with the employee. Total probation will not exceed [Number] months.
- During probation, either side may end employment with [Number] days' written notice or pay in lieu of notice. After confirmation, the notice period in the appointment letter applies.
- Wages, statutory contributions and leave accrue from the joining date. Some discretionary leave types may be unavailable during probation, as listed in the Leave Policy, but no statutory entitlement is reduced.

5. Procedure
- At the midpoint of probation, the reporting manager holds a check-in and records feedback for the employee.
- [15] days before the end date, HR sends the review form to the reporting manager.
- The manager rates the employee on [Role-Specific Criteria] and recommends confirmation, extension or non-confirmation with reasons, at least [7] days before the end date.
- If extension or non-confirmation is recommended, the employee is told the reasons and given an opportunity to respond before a decision is taken.
- HR issues a confirmation letter, an extension letter with the improvement plan and new end date, or a non-confirmation letter stating the notice or pay in lieu and the settlement of dues.
- Non-confirmation decisions are approved by [Designation].
6. Responsibilities
- Reporting managers: set clear expectations in the first week, give feedback and complete the review on time.
- HR: track end dates, send reminders, issue letters and ensure consistency.
- Employees: understand the expectations of the role and ask for feedback.
7. Exceptions
For rehires and senior hires, [Designation] may shorten or waive probation. Any such decision is recorded in the appointment letter.
8. Review
[HR Head Designation] reviews this policy every [24] months, looking at how many probations were extended or not confirmed and whether reviews were completed on time.
What to include
A fixed length and one extension
State the probation length by category and allow a single extension with reasons. Repeated extensions leave employees in limbo and suggest the decision is being avoided.
Review before the end date
Schedule the review well before probation ends so that there is time to talk to the employee and issue the right letter on time.
Reasons and a chance to respond
When the recommendation is extension or non-confirmation, share the reasons and let the employee respond. It is fairer and makes the decision easier to defend.
Notice during probation
Set a shorter notice period for probation that works both ways and allows pay in lieu. Say clearly when the longer post-confirmation notice starts.
Statutory rights from day one

A letter for every outcome
Issue a confirmation, extension or non-confirmation letter in each case. An employee who hears nothing is left guessing about their status and notice period.
Common mistakes to avoid
- Letting the probation end date pass with no review and no letter.
- Extending probation again and again instead of taking a decision.
- Ending employment on the last day of probation without any earlier feedback.
- Withholding PF or ESI contributions from probationers who are eligible for them.
- Stating one probation period in the appointment letter and another in the policy.

What is the normal probation period in India?
No single period applies to every employer. It is set by the company in the appointment letter and, where they apply, by standing orders. Many companies use three to six months for staff roles, with one extension if needed. Keep it long enough to judge the work fairly, but not so long that it delays commitments to the employee.
Can probation be extended?
Yes, if the policy and appointment letter allow it. Extend only once, before the original end date, in writing, with specific reasons and an improvement plan. If performance still falls short at the end of the extension, decide on non-confirmation rather than extending again.
What is the notice period during probation?
It is whatever the appointment letter and probation policy state, and it is usually shorter than after confirmation, for example 7 to 30 days. It should apply both ways and allow pay in lieu of notice. Where standing orders or other rules apply to your establishment, check that your terms meet them.
Is an employee on probation entitled to PF and leave?
Yes. Probation does not suspend statutory rights. Eligible employees are covered for PF and ESI from joining, wages must be paid on time, and leave accrues as per the leave policy and the law. The company may restrict some discretionary leave types during probation, but it cannot reduce any statutory entitlement.
