1. Purpose
This policy sets out when [Company Name] will consider rehiring former employees, and how their selection, pay, probation and past service are handled, so that decisions are fair and consistent.
2. Scope
It applies to former permanent and fixed-term employees of [Company Name] who resigned, whose fixed term ended, or whose employment ended for reasons other than proven misconduct, and who apply for any position.
3. Definitions
- Former employee: a person who was on the rolls of [Company Name] and whose employment has ended.
- Rehire eligibility status: Eligible, Eligible with review, or Not eligible, recorded by HR at the time of exit with reasons.
- Break in service: the period between the last working day of earlier employment and the new joining date.
4. Policy
- Eligible: former employees who left in good standing, served their notice or agreed an early release, and whose performance was satisfactory.
- Eligible with review: those who left without completing notice or with recorded performance concerns. They may be rehired if [Designation] approves after reviewing the file.
- Not eligible: those dismissed after a disciplinary inquiry, those who absconded, and those whose verification revealed false information.
- A former employee may apply after at least [Number] months from their last working day, unless [Designation] waives the gap.
- Rehired employees go through the normal selection process for the role, including reference checks covering the period since they left.
- Rehire is fresh employment with a new appointment letter and a new joining date for service-linked benefits, unless the Company agrees in writing to recognise earlier service.
- Pay is fixed for the role and current internal levels, not simply by adding a raise to the last drawn salary.
- Probation is waived for those rehired within [12] months into the same or a similar role, and others serve [Number] months.
- Leave balances from earlier service are not carried over, and the employee continues with their existing UAN for PF.
5. Procedure
- At every exit, HR records the rehire eligibility status with reasons, approved by the manager's manager.
- When a former employee applies, HR checks the status and the exit file before shortlisting.
- HR runs updated background checks for the period since exit.
- HR issues an offer and a new appointment letter that states how earlier service is treated.
6. Responsibilities
- HR: record eligibility at exit, review applications and document the treatment of past service.
- Hiring managers: assess former employees on current requirements, not on familiarity.
- Approvers: decide review cases on the record and give reasons.
7. Exceptions
In exceptional circumstances the managing director may approve rehiring someone marked Not eligible. The reasons are recorded in writing and kept in the employee's file.
8. Review

Record rehire eligibility with reasons when each person leaves. Deciding years later, from memory or hearsay, leads to unfair and inconsistent calls.
A cooling-off period
A minimum gap after exit discourages people from leaving for a short-term raise and returning soon after, while allowing a waiver for critical roles.
The same selection standard
Interview and check former employees for the current role. The job, the team and the person may all have changed since they left.
Past service in writing
State in the new appointment letter whether earlier service counts. Unclear service dates are a common source of gratuity and seniority disputes.
Pay set afresh
Fix pay against current internal levels for the role. Adding a raise to the old salary can put a returning employee well above peers who stayed.
Leave and PF
Say that leave balances do not carry over and that the employee keeps the same UAN. Both questions come up in the first week back.
Common mistakes to avoid
- Deciding rehire eligibility years later from memory, with nothing noted at exit.
- Rehiring at the old salary plus a raise without checking current internal pay levels.
- Leaving the treatment of past service unclear, which leads to gratuity disputes later.
- Skipping reference checks for the period since the employee left.
- Creating a new UAN instead of continuing the employee's existing one.

What is a rehire policy?

Does past service count when an employee is rehired?
Usually not, unless the company agrees otherwise in writing. Rehire is normally treated as fresh employment with a new joining date, so leave and service-linked benefits start again, and gratuity for the earlier period, where due, should have been paid at exit. State the treatment of past service in the new appointment letter.
How long should a former employee wait before being rehired?
A gap of a few months after the last working day is common. It discourages people from leaving for a short-term raise and returning soon after. The policy can allow a senior manager to waive the gap for critical roles, and the rule should be applied consistently so that returning employees are not treated arbitrarily.
Can an employee who absconded be rehired?
Most policies mark employees who absconded as not eligible, because they left without notice or handover. If there were genuine circumstances, such as a medical emergency explained later, a senior manager may review the case. Record the decision and the reasons either way.
